Immigration Executive Actions

Recent Policies Explained by Chicago Immigration Attorneys

An executive action is any action instated by the president. They are used to achieve certain goals, set management standards, and outline policy intentions.

An executive action can be given as:

  • An executive order
  • A presidential proclamation
  • A presidential memoranda

Over the years, our presidents have announced and implemented countless executive actions regarding immigration policy. Executive actions that are related to immigration can profoundly impact how people travel into and out of the country. A skilled Chicago immigration attorney must stay on top of all immigration executive actions as they can affect the ways we submit paperwork and seek certain immigration statuses. DACA

Deferred Action for Childhood Arrivals – or DACA – is a program that permits certain individuals who were brought to the U.S. as juveniles to request that action regarding their immigration status be deferred for two years. The program was born from ex-Secretary of Homeland Security Janet Napolitano’s June 15, 2012 memorandum.

Recently, there has been significant controversy and debate regarding the constitutionality of such a program. In September 2017, Attorney General Jeff Sessions announced the government’s termination of DACA – however, shortly after this announcement, multiple lawsuits challenged the termination and overturned certain aspects of it. As of now, per a federal court order, USCIS still accepts requests to renew DACA grants but is not accepting new requests for deferred action. The Chicago immigration attorneys at Buchmiller Immigration, LLC can help you submit a request for renewal if you have previously been granted deferred action under DACA.

Travel Ban

On January 27, 2017, President Donald Trump signed an executive order preventing individuals of certain nationalities from entering the U.S. for 90 days.

The countries banned in this order were:

  • Yemen
  • Iran
  • Iraq
  • Somalia
  • Libya
  • Sudan
  • Syria

Even individuals who held a green card in the U.S. were subject to the restrictions. The order was later revoked in March 2017 after much controversy. A presidential proclamation was then issued in September 2017 that partially or fully blocked individuals from eight different countries from entering the U.S. – but U.S. District Courts in Hawaii and Maryland currently prevent the enforcement of the ban on Iran, Libya, Syria, Chad, Yemen, and Somalia. There is currently still a ban on North Korea and Venezuela.
